Renewing your residence permit in Germany: when and how to avoid problems

Translated from the Arabic original. Read in Arabic

Renewing a residence permit is one of the most stressful procedures for residents of Germany, especially with the long waits at many foreigners’ authorities. There is one golden rule: apply before your permit expires. This guide explains why, and how to protect yourself if your appointment is delayed.

Why apply before your permit expires?

Under section 81 of the Residence Act, if you apply for renewal before your current permit expires, your residence is treated as continuing legally on the same terms until a decision is made, even if the office takes months. If you apply after it has expired, you may lose this protection and temporarily be without lawful status, with problems for work, travel and even for counting your residence years towards citizenship.

When to start

Start at least six to eight weeks before your permit expires, and much earlier in cities known for long waits. Some foreigners’ authorities send a renewal invitation, but most do not, so it is your responsibility. Set a reminder on your phone three months before the expiry date printed on your card.

How to apply

Many foreigners’ authorities (Ausländerbehörde) now use online forms or an official email address instead of in-person appointments. Search your office’s website for "Verlängerung Aufenthaltstitel". If you cannot get an appointment before your permit expires, send your application in writing by email or registered post before the expiry date and keep proof of sending. That proof is what protects you.

Documents usually required

A valid passport, your current residence card, a recent biometric photo, the application form, and proof that the purpose of your residence continues. For work: your employment contract and latest payslips. For study: proof of enrolment and funding. For family: proof that the family relationship continues. Add proof of health insurance, your tenancy agreement and your registration certificate. A fee set by the Residence Ordinance is payable.

The fictional certificate (Fiktionsbescheinigung)

If no decision has been made before your permit expires, the office issues a fictional certificate confirming that your residence continues legally until a decision. It matters for your employer and when travelling. But check your travel situation before booking: not every type allows re-entry equally easily, so ask your office before any trip outside Germany.

After approval

The electronic residence card (eAT) is produced by the Federal Printing Office, which can take several weeks, and you collect it in person after receiving a notification. Check the printed details as soon as you receive it, especially your name, the legal provision and any note about work authorisation.

If your situation changes

If you change jobs or the purpose of your stay changes, you may need permission from the foreigners’ authority before you start, depending on your permit. Do not assume permission is automatic; ask in writing before signing a new contract.
